By accessing or using the website at www.techgynt.com or engaging Techgynt Infotech Private Limited (“Techgynt”, “we”, “us”, or “our”) to provide services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

1. Services

Techgynt provides software development, data engineering, analytics, AI/ML development, cloud infrastructure, UI/UX design, and IT consulting services (“Services”) to clients globally. The specific scope, deliverables, timeline, and fees for each engagement are agreed separately in a written Statement of Work (SOW), project agreement, or email confirmation between Techgynt and the client.

These Terms apply to your use of our website and, unless a separate agreement governs, to any Services you engage us to deliver.

2. Use of This Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the website to transmit unsolicited communications (spam).
  • Attempt to gain unauthorised access to any part of the website or its underlying systems.
  • Use automated tools (scrapers, bots) to extract content in bulk without our prior written consent.
  • Reproduce or republish content from this website without attribution and our written permission.

3. Intellectual Property

All content on this website — including text, graphics, code samples, case study descriptions, and design — is the property of Techgynt Infotech Private Limited and is protected by applicable intellectual property laws.

For client projects, intellectual property ownership is as agreed in the project contract. In the absence of a written agreement, the default is:

  • Code and deliverables created specifically for a client project are assigned to the client upon full payment.
  • Techgynt retains ownership of pre-existing tools, frameworks, and general-purpose components used in delivery.
  • Techgynt reserves the right to mention the project in our portfolio unless a confidentiality agreement restricts this.

4. Payment Terms

Payment terms are specified in the project agreement or invoice. Unless otherwise agreed:

  • A deposit (typically 30–50%) is required before project commencement.
  • Final payment is due before final deliverable handover.
  • Invoices are payable within 14 days of issue.
  • Late payments may be subject to interest at 2% per month on the outstanding balance.

We accept payment in INR, USD, GBP, AED, and AUD via agreed transfer methods.

5. Confidentiality

We treat all client information, business requirements, and source code shared with us as confidential. We are happy to sign a mutual Non-Disclosure Agreement (NDA) before project discussions. Our team members operate under internal confidentiality obligations.

6. Warranties and Disclaimers

We warrant that our Services will be delivered with reasonable skill and care, and that deliverables will materially conform to the agreed specifications at handover.

This website and any information on it is provided “as is” without warranty of any kind. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Techgynt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or our Services, including but not limited to loss of profits, data, or business opportunity.

Our total liability for any claim arising out of or related to a specific project engagement shall not exceed the total fees paid by the client for that engagement in the three months preceding the claim.

8. Termination

Either party may terminate a project engagement with written notice as specified in the project agreement. In the absence of a specific agreement:

  • Client may terminate with 14 days written notice; fees for work completed to date are payable.
  • Techgynt may terminate immediately if the client fails to pay outstanding invoices after a reasonable cure period.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our Services shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India, unless otherwise agreed in writing.

For clients in the UK, EEA, USA, UAE, or Australia, we are open to agreeing on alternative dispute resolution mechanisms in the project contract.

10. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects when the most recent changes were made. Continued use of our website or Services after changes constitutes acceptance of the updated Terms.
